Legal Advisor, USAID/Bosnia and Herzegovina Fiscal Reform Activity

Period of Performance: two years with possibility of extension

Location: Sarajevo, Bosnia and Herzegovina

Background

DAI is seeking qualified candidates for the role of Legal Advisor on the 5-year, $11.5M USAID-funded Fiscal Reform Activity in Bosnia and Herzegovina. The purpose of the Activity is to build on and expand fiscal sector reform to increase efficiency, reduce tax compliance costs, and align the country’s regulatory framework with international and European changes in the international tax environment. The achievement of overall purpose will be measured by the number of internal processes improved and optimized, the number of business-facing services improved and digitized as well as the number of legislative acts adopted to align the country with the international tax best practices. The Activity has five components:

  1. Produce analysis, reports, recommendations for tax administrations.
    1. Implement recommendations produced under component 1.
    1. Improve operational efficiency, efficacy and capacity of three Tax Administrations and competent Ministries of Finance at state and entity-levels.
    1. Improve direct tax legislative framework.
    1. Reduce the number of parafiscal fees.

Key Duties and Responsibilities

The Legal Advisor will be a member of the project team responsible for legislative drafts (either draft laws/bylaws and/ or amendments to existing laws/bylaws, and legal analysis) deliverables. The responsibilities include:

  • Drafting of legislation that is related to direct taxation, fees and charges and work of relevant institutions.
  • Drafting of legislation that regulates processes and modus-operandi of tax administrations and those that regulate how taxpayers interact with tax administrations and other tax enforcement institutions (tax procedure).
  • Producing legal analysis of relevant legislation and constitutions.
  • Provide technical assistance, advisory support, and facilitation to key partners.
  • Other duties, as assigned by the COP.

Required Qualifications

  • Bosnia and Herzegovina citizenship or permanent resident status, legally authorized to work in BiH.
  • Bachelor’s degree in law.
  • At least 10 years of progressive professional experience, with demonstrated expertise in legislation drafting and legal analysis.
  • Experience in public financial management (PFM), tax policy, or tax administration is preferred.
  • Excellent relationship-building/maintenance and communication skills.
  • Ability to build government capacities and develop outreach and advocacy strategies.
  • Experience implementing complex activities in politically challenging and unstable environments.
  • Excellent attention to detail and proven capacity to carry out multiple tasks concurrently.
  • Adaptability in responding to changing priorities and needs.
  • Professional proficiency in Bosnian and English.
